Is Your Background Check Process Compliant?

Recent court cases have resulted in multi-million dollar judgments against employers for failing to have adequate disclosure notices prior to conducting background checks. Without the proper forms, employers can easily be out of compliance with the Fair Credit Reporting Act (FCRA). EctoHR, Inc. certainly takes this issue seriously and provides its clients with updated Inquiry Release and FCRA disclosure forms to be used in the recruiting process.

Additionally, EctoHR’s approach is to disclose and discuss the background check requirements with every candidate at the beginning and throughout the recruiting process, from having it on the job posting to the offer letter. While the compliance aspect of disclosure is important, even more important possibly, is the tone this sets with candidates, providing them with a clear perspective that EctoHR (and its client) is thorough, systematic and professional. Discussing the background check process early and often also has the benefit of providing candidates with multiple opportunities to disclose any potential background concerns and for others to self-select out of the process if they will not be able to meet our clients’ standards.

A typical background check consists of the following:

  • Criminal Records Check (National and Local)
  • Thorough Reference Checks
  • Employment and Education Verification
  • Motor Vehicle Report (for any position requiring driving)
  • Credit History Check (for any position handling cash or with access to confidential or financial records)
  • Technical Assessments & Personality Profile
