Impacts of the SCOTUS Ruling

On Friday, June 26, 2015 the Supreme Court ruled that same-sex couples have a constitutional right to marry, meaning that same-sex marriages must be acknowledged nationwide. With this ruling, employers should prepare to implement changes within their companies. The likely outcomes of the ruling include:

  • Extension of Benefits to Same Sex Spouses
  • Extension of the Family and Medical Leave Act (FMLA)
  • Employee Handbook and Company Policy Updates, including changes to bereavement

Employers should consider taking the following steps to begin the implementation process:

  • Contact your Group Benefits consultant to find out how the carriers are handling this change and what resources may be available to you from the carriers or the agency.
  • Meet with your HR team to discuss policy changes, significance of the changes, and how to communicate the changes to staff
  • Continue to monitor and review guidance from the Federal and state government as it becomes available
